QUESTIONS / PRESCRIBING

How can I prescribe?

You want to see patients by video, prescribe through an online platform, or treat patients who need controlled substances. Before you write the first prescription, the rules on licensure, registration and patient evaluation all have to line up.

WHAT YOU’RE ASKING

Can I prescribe this medication, to this patient, in this way, and what do I need in place first?

WHY IT MATTERS?

Prescribing rules follow the patient. You generally need a license in the state where the patient is located, and states set their own requirements for how a prescribing relationship is established by telehealth.

Controlled substances add another layer. Federal law limits prescribing controlled substances over the internet without an in-person evaluation, subject to specific exceptions, and the temporary federal telemedicine flexibilities have been extended several times and may change. DEA and state controlled substance registrations, prescription monitoring program checks and state limits on certain drugs can all apply.

WHAT WE REVIEW

  • Where your patients are and which licenses and registrations you need

  • How the prescriber-patient relationship is established, in person or by telehealth

  • Controlled substance prescribing under federal and state rules

  • Online and telehealth platform agreements and workflows

  • Supervision and scope of practice for NPs and PAs who prescribe

  • Prescription monitoring, documentation and record-keeping

WHAT YOU LEAVE WITH

A clear picture of what you can prescribe, to whom and how, the registrations and policies you need in place, and the risks to watch as the rules change.
